It includes commentary from Orin Kerr regarding the Nosal holding of the 9th Circuit and his recommendation that Congress act to amend the CFAA to clarify the ambiguity in the statute regarding "unauthorized access" and "exceeds authorized access" which has led to a circuit split on the statute's reach.
